What happens a lot of times when you have these appeals, what the court is looking at is the language of the statute, and that's the world that they operate in, okay? And we're going to get there in just a minute. So what was Francis' position on appeal? First, that the decision did not give any credit to the only expert witness testimony that was provided. What I didn't say was that the Board of Nursing did not put on any expert witness to say, or any evidence about whether there was harm or whether there was a potential for harm. In practical terms this result meant that the NCLEX could continue with a single estimate of candidate ability, a single passing standard and a single pass/fail outcome. Subsequent studies looked specifically at item prototypes (some of which fared extremely well and others of which were ultimately discarded or revised), new partial credit scoring models, and overall test design (e.g., the optimal number of case studies to include). Meanwhile, existing test development activities such as item writing workshops, bias/sensitivity review, and standard setting were adapted to ensure appropriateness to the multitude of changes in content, format and focus.

Scenario 1: Some hospitals use a service that allows family members and friends to receive consistent information via a single website, and eliminates the need to place and receive numerous tele- phone calls. Its functionality is similar to a blog. One family set up such a site for their sick child. Many of the nurses who cared for the child were also “friends” on the site. One nurse posted to the site: “I had a severe migraine headache at work today… and was surprised I could even function.” The patient’s mother read the posting and the next day, spoke to the nurse manager to inquire if her child was safe and if the nurse is able to provide competent care after what she posted.

Strategic initiatives, these are too small, but I won't go into a lot of these other than to say that we're developing a couple of different ways in terms of the licensure reform process. You've heard us talk about that. If you've looked at the NCLEX site out here with remote proctoring, you may have seen some of the things that we actually are going to turn in. There's something called a member board portal that we hope will turn into ways to expedite use of data dashboard and a variety of things.
