Retained Jurisdiction TAANA’s paper also argues that “reciprocal” action against a nurse’s license in State A, based on an action previously taken by State B’s nursing board against the nurse’s license in that state, constitutes impermissible double jeopardy for the nurse. TAANA’s position misapprehends the notion of double jeopardy and, again, ignores the public safety role of professional licensing regulation. The concept of double jeopardy is rooted in the common law and the Fifth Amendment to the United States Constitution.

The Board of Nursing is a health oversight agency as defined in the Health Insurance Portability & Accountability Act of 1996 (HIPAA), Public Law 104-191, [the (“Privacy Rule”)], and as such covered entities may disclose protected health information to health oversight agencies for the purposes of legally authorized health oversight activities, such as audits and investigations necessary for oversight of the health care system and government benefit programs, without an individual’s authorization for permission. (See the Privacy Rule [45 CFR § 164.512(d)].)

INSIGHT #9: Find facts that raise the fewest questions. INSIGHT #10: Based on the absence of evidence, find facts that negate a party’s proposition. INSIGHT #11: Based on conflicting evidence, find facts that negate a party’s proposition. INSIGHT #12: Reasons for rejecting a party’s propositions are themselves fact-findings. INSIGHT #13: Rather than reasoning only from a hypothesis to a conclusion based upon evidence, also reason from the evidence to a hypothesis that might explain it. INSIGHT #14: Intuition is not an easy way of short-circuiting method; but the reward reserved precisely for the master of method.
