In other words, most program failures occurred within the first three years of participation in the program. This figure shows that the percent of nurses successfully completing a program distinctly correlates with the number of times she or he is selected for a drug test. It also shows that after 26 tests per year, roughly twice a month, there does not seem to be much of an increase in the percent who successfully completed the program. This suggests that establishing a twice a month random selection for drug testing as a program standard would be highly effective.

And some of you may remember that the president actually signed a criminal justice reform bill called the First Step Act into law in his first term. Well, the next version of that bill is called the Next Step Act. It's sponsored by Senator Cory Booker, who's a Democrat, but it is receiving bipartisan support and one provision in there I think you all should be aware of is called the Fair Chance Licensing Act and what it would do is specify conditions that states must meet in order to access records from the FBI background check system. So, these conditions include that, you know, you may not access information about diversion programs or alternative to discipline programs.

They argued that the reliance on criminal background history in licensing exacerbates racial inequality. NELP legislative advocacy has been quite successful. The next slide shows a snapshot of their current legislative successes. In 2017, you can see NELP supported legislation aimed at what they call fair chance licensing and was signed into law in four states. In 2019, they had success in nine states. They have not yet published their 2020 numbers but I can inform you that they were successful in the District of Columbia. In 2017, a legislation was introduced in the DC council supported, of course, by NELP, the legislation was called Removing Barriers to Occupational Licenses Amendment Act of 2017.

And of course, that is a concern of regulators right now. There has been some issues with fraud and people illegally obtaining a nursing degree. How likely is it that we would have to be concerned that somebody that isn't really qualified, and is not really a nurse or a licensed provider, could set up a website and offer telehealth services, and even internationally, and bill for those services? - Yeah, that's exactly what is of concern, is that it's a little harder to police websites, international websites, than it is things in the country. And seeing somebody face-to-face is a much better control than an international website.
